New Episode of Hablando con Carolina: Maduro’s Arrest, Motion to Reopen Your Case, and VAWA for Parents

In this episode of Hablando con Carolina, immigration attorney Carolina Antonini breaks down the most urgent issues facing immigrant communities at the start of 2026. Carolina explains how the arrest of Nicolás Maduro may impact Venezuelan immigrants, who may apply for US citizenship, and what you can do if you are at risk of deportation.

If your immigration status may be affected by any of these developments, consult with one of Antonini & Cohen’s Atlanta immigration attorneys as soon as possible. Contact us at (470) 428-3200 to schedule a consultation.

04:22 – Maduro’s Arrest’s Impact on Venezuelan TPS and Asylum

Carolina warns that the US government may argue that conditions in Venezuela have “improved” following Maduro’s arrest, potentially making temporary protective status (TPS) and asylum cases more difficult. Venezuelan nationals should consult with an Antonini & Cohen Atlanta immigration attorney to explore alternative legal options.

05:25 – New USCIS Photo Policy

USCIS will no longer accept self-submitted photos for certain applicants. Instead, USCIS will only accept photos taken during a biometrics appointment. While implementation of this rule remains inconsistent, Carolina advises applicants to continue submitting passport-style photos with their applications to avoid unnecessary rejections or delays.

08:24 – Asylum Seekers Deported to a Third Country

A denied asylum is increasingly resulting in deportation to a third country. Antonini & Cohen’s immigration attorneys have decades of experience handling complex asylum and deportation defense. If you are facing removal or uncertainty about your options, schedule a consultation to understand your rights and build a strong legal strategy.

11:39 – Motions to Reopen and Risk of Deportation

Carolina explains how filing a motion to reopen a prior removal order does not automatically stop deportation.

14:57 – Should You Apply for US Citizenship Now?

Carolina explains that fear alone should not prevent eligible individuals from applying for US citizenship. Applicants should undergo a careful legal review to ensure they are not subject to a ground of removability, criminal or otherwise. If eligible, though, individuals can and should move forward with confidence. Speaking with an Antonini & Cohen immigration attorney will help you understand your eligibility and apply with clarity and peace of mind.

17:59 – If a Spouse of a US Citizen Misses Their Hearing

Individuals placed in removal proceedings for missing an immigration court hearing may still be eligible to pursue consular processing through marriage to a US citizen. Carolina discusses different scenarios and the requirements for consular processing.

22:13 – VAWA Cases Involving Abuse by US Citizen Children

Parents may qualify for protection under VAWA if they have been abused by a US citizen child over 21. Abuse includes physical violence, threats, destruction of property, or extreme emotional cruelty, such as threatening to call immigration. Carolina warns that false or exaggerated claims have led to increased scrutiny. An experienced Antonini & Cohen attorney will ensure that your case is well-documented to increase your chances of success.
