Trump’s Executive Order and Initial Legal Response
Immediately after taking office, President Trump issued an executive order attempting to limit birthright citizenship in the United States. A U.S. District Court soon thereafter issued an injunction, in effect blocking nationwide enforcement of the executive order.
The Legal Battle Continues
On June 27th, the Supreme Court limited the power of U.S. District Courts to issue nationwide injunctions. But the Supreme Court did NOT rule on the constitutionality of birthright citizenship or directly address the executive order itself, although it opened the door for partial enforcement of the order.
Following the Supreme Court's decision, the American Civil Liberties Union (ACLU) filed for class certification in a U.S. District Court in New Hampshire. The ACLU aimed to block Trump’s attempted restrictions on birthright citizenship nationwide and protect the rights of all individuals born in the US. The judge issued a preliminary injunction, temporarily pausing enforcement of the executive order, so the legal battle over birthright citizenship continues.
