What is a T Visa?

T visa is an immigration benefit that provides victims of human trafficking, including sex trafficking and labor trafficking, with a pathway to a green card.  However, a T visa is not a shortcut to legal status and does not apply to every difficult situation.

Eligibility for a Sex Trafficking T Visa

Examples that may qualify:


  • Being pressured, threatened, or deceived into performing sex acts

  • Being controlled or manipulated through fear, threats, or false promises


Examples that typically do not qualify:


  • Voluntary participation in sex work without threats or deception

  • Situations involving abuse but no exchange of value tied to trafficking

Eligibility for a Labor Trafficking T Visa



Labor trafficking also requires proof of force, fraud, or coercion, not just unfair or difficult working conditions. It involves recruiting or controlling someone for labor through threats, deception, or pressure. This may include threats of physical harm, financial harm, or immigration consequences, as well as forcing someone to continue working through fear or manipulation.


Examples that may qualify:


  • Forced domestic work under threats of violence

  • An employer refusing to pay wages while threatening to report the worker to immigration if they leave


Examples that typically do not qualify:


  • Being paid late or underpaid without threats or coercion

  • Poor working conditions alone without control or intimidation


Applying for a T visa based on workplace issues alone, without force, fraud, or coercion, will most likely lead to a denied application.
