04:22 – DACA Rumors and Misinformation

The court has not issued a final decision on the status of new DACA applications. Carolina warns that filing prematurely based on misinformation could expose you to serious immigration risks. Consult with an Antonini & Cohen immigration attorney before taking any action.

09:56 – New $100 Annual Asylum Fee

A new $100 annual fee now applies to many asylum applications pending with USCIS or immigration court. Carolina explains who must pay, how to pay, and why failure to pay on time can result in rejection or denial of an asylum application, even if the case was properly filed.

10:58 – Deportation Orders for Arriving Late to Court

Immigration judges may issue a deportation order if you are not present when your case is called. If you missed your hearing, you may file a motion to reopen within 180 days of the hearing. You are still at risk of being detained during the 180 days, so file immediately.

18:40 – Bond vs. Habeas Corpus in Detention Cases

Carolina explains how filing a habeas corpus petition in federal court may be an option for individuals who are not eligible for bond.

21:20 – Changes to the US Citizenship Test

The new naturalization civics test now consists of 20 questions from a list of 128, with 12 correct answers required to pass. Carolina anticipates additional changes to the naturalization process and advises eligible applicants to apply as soon as possible.

23:30 – Delayed Green Card Approvals for Family Members

It is normal for one family member’s green card to be approved before another’s, even if they filed at the same time. If you have concerns about your application, consult with an Antonini & Cohen immigration attorney to review your pending case and identify any issues that may put you at risk of denial or being placed in removal proceedings.
