02:09 – Divorce After Receiving a Conditional Green Card


Divorcing after receiving a two-year conditional Green Card does not automatically mean you lose your status. However, you must prove the marriage was entered into in good faith when filing to remove conditions. Carolina advises contacting an experienced Antonini & Cohen immigration attorney for divorce-based removal of conditions cases to avoid mistakes that may lead to denial or even being placed in deportation proceedings.

No. Carolina explains that the Affidavit of Support (Form I-864) is a contract with the federal government, not with your spouse. Divorce does not automatically end those obligations, and support responsibilities may continue until the sponsored immigrant becomes a US citizen or works and pays taxes for approximately 10 years.

No. A US citizen under 18 years old may file a marriage petition, but cannot complete the Green Card process until they are legally old enough to sign the required financial sponsorship documents.

Yes. If you are a US citizen, you may petition for your stepchild, even if your spouse cannot obtain residency due to prior immigration issues. But, your marriage creating the stepparent relationship must have occurred before the child turned 18.


11:41 – Naturalization Risks After Separation from a US Citizen Spouse

If you separated from your spouse during your naturalization process but are still living together, you may still qualify under the three-year provision. Carolina explains why it is important to update USCIS about a separation to avoid delays, denials, or future immigration consequences.
